Avokati i Hashim Thaçit, Luka Misetic, ka bërë të ditur se mbrojtja do ta apelojë aktgjykimin e Trupit Gjykues, duke pretenduar se në të janë bërë gabime të rëndësishme ligjore, faktike dhe procedurale.

Mishetic ka thënë se mbrojtja gjatë gjithë procesit gjyqësor ka ngritur shqetësime lidhur me drejtësinë procedurale, veçanërisht për mënyrën e ndërhyrjes së drejtpërdrejtë të anëtarëve të Trupit Gjykues përmes pyetjeve ndaj dëshmitarëve dhe palëve. Sipas tij, këto ndërhyrje kanë krijuar përshtypjen e mungesës së paanshmërisë.

“Mbrojtja mban qëndrimin se ndërhyrjet gjyqësore e kanë tejkaluar kufirin e kërkimit neutral të së vërtetës, duke cenuar përshtypjen e paanshmërisë që kërkohet sipas standardeve ndërkombëtare të drejtësisë. Kjo mungesë paanshmërie tashmë përshkon edhe aktgjykimin e Trupit Gjykues”, ka deklaruar Misetic.

Ai ka ngritur pretendime edhe lidhur me përfshirjen e Thaçit në rastin e vrasjes së Behajdin Allaqit. Sipas Misetic, Trupi Gjykues e ka përmendur publikisht këtë rast, ndërkohë që më herët kishte urdhëruar palët të mos e diskutonin atë në seanca publike dhe kishte vendosur që provat përkatëse të mbaheshin konfidenciale.

“Trupi Gjykues e ka shpallur publikisht z. Thaçi fajtor për një vrasje, ndërkohë që provat mbi të cilat është bazuar ky përfundim i janë mbajtur të fshehura shqyrtimit publik”, ka thënë ai.

Misetic ka deklaruar se mbrojtja konsideron se gjetjet për fajësinë e Thaçit përtej dyshimit të arsyeshëm janë mbështetur në prova të pamjaftueshme dhe të pakonfirmuara.

Ai ka theksuar se Thaçi e mohon çdo përfshirje në vrasjen e Allaqit dhe se, sipas tij, ish-presidenti do ta mirëpriste shqyrtimin publik të provave mbi të cilat është bazuar ky konstatim.

“Mbrojtja do t’i apelojë vendimet e Trupit Gjykues për shkelje të të drejtave të tij themelore për një gjykim të drejtë, të garantuara nga Konventa Evropiane për të Drejtat e Njeriut dhe Kushtetuta e Kosovës”, ka shtuar Misetic.

Sipas tij, njoftimi zyrtar për apel do të dorëzohet pranë Panelit të Apelit, me synimin për të kundërshtuar ato që mbrojtja i konsideron si gabime faktike, ligjore dhe procedurale.

Hashim Thaçi wishes to express his sincere appreciation for the outpouring of support he and Kadri Veseli, Rexhep Selimi and Jakup Krasniqi have received from the people of Kosovo and internationally, and calls upon Kosovo’s citizens to remain peaceful in response to yesterday’s injustice. Mr. Thaçi’s lawyers will appeal yesterday’s Trial Judgment before the Appeals Panel of the Kosovo Specialist Chambers (KSC), asserting significant errors of law and fact that prejudiced the fairness of the proceedings. Throughout the trial, the Defence repeatedly raised concerns regarding procedural fairness, including the extensive scope of questioning conducted directly by members of the Trial Panel in a manner that did not create the appearance of impartiality. The Defence maintains that judicial interventions crossed the boundary of neutral truth-seeking, compromising the appearance of impartiality required under international standards of justice. That lack of impartiality now permeates the Trial Panel’s Judgment. The Defence submits that the Trial Panel’s findings of guilt beyond a reasonable doubt rely on insufficient and uncorroborated evidence. Moreover, the Trial Panel yesterday publicly claimed that Mr. Thaçi was involved in the murder of Behajdin Allaqi after having ordered all parties in the case not to discuss the case of Mr. Allaqi in public session in court, and after having ordered all of the evidence related to that case to be kept confidential. The Trial Panel has thus publicly convicted Mr. Thaçi of a murder while also keeping the evidence on which it drew this conclusion shielded from public scrutiny. Mr. Thaçi would welcome such public scrutiny of the evidence. The Defence will appeal the Trial Panel’s decisions for violating his fundamental fair trial rights under the European Convention on Human Rights and the Kosovo Constitution. Mr. Thaçi expressly denies any involvement in murders. Adherence to rigorous standards of procedural fairness is vital to maintaining public confidence in international criminal institutions.
